That reasoning only works to an extent, I believe.  The copyright law, 
AFAIK, functions on the actual license verbage (GPL)... not the perceived 
intent of the adopters of the license.  The solution to strive for is one 
that is in accordance with the GPL as written... the rest is... 
"courtesy".
